Welcome to Pomelli. These Terms of Service ("Terms") govern your use of the Pomelli website and services (the "Service"). By using our Service, you agree to these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Using Our Services

Pomelli provides a service that allows users to analyze their brand and generate on‑brand marketing campaigns and content from brand information and links you provide in prompts. Direct file upload is not supported. You can use our Service without creating an account.

While using our Service, you agree not to:

• Use the Service in any way that violates any applicable laws or regulations
• Provide or link to content that infringes on intellectual property rights of others
• Provide or link to content that is offensive, harmful, or violates the rights of others
• Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service
• Use the Service to generate content that promotes hate speech, violence, or illegal activities
• Scrape, crawl, or employ bots or other automated methods to access the Service
• Impersonate another person or misrepresent your affiliation with a person or entity

3. Content and Licenses

When you use our Service to generate marketing assets and campaigns:

• You retain ownership of any brand assets referenced via links you include in prompts (e.g., logos, brand guidelines)
• You grant us a license to fetch, cache, use, and process any linked content solely for the purpose of providing the Service to you
• You own the rights to the marketing assets and campaigns generated by our Service based on your inputs
• You may use the generated assets for personal and commercial purposes
• Generated assets may include a small attribution to Pomelli

We do not claim ownership of the marketing assets you create using our Service. However, we may use anonymized examples of generated videos for promotional purposes, improving our algorithms, or displaying in our gallery (unless you opt out).

4. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Pomelli and its licensors. The Service is protected by copyright, trademark, and other laws.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Pomelli.

5. User Accounts

While you can use our Service without an account, you may choose to create an account to save your ASMR videos and preferences. If you create an account:

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

6. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account if you have created one.

7. Limitation of Liability

In no event shall Pomelli, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use or alteration of your transmissions or content

8. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Pomelli does not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
